David M. Banker is the founder and principal of Law Offices of David M. Banker, Esq., where he focuses his practice on business bankruptcy, creditors’ rights, and complex restructurings nationwide. He advises institutional trade creditors, debtors, plan trustees, asset acquirers, unsecured creditors’ committees, investment funds, secured lenders, and lessors across a wide range of industries and jurisdictions.
Mr. Banker advises clients at every stage of the bankruptcy process, from pre-bankruptcy planning through a successful emergence. His experience includes negotiating critical vendor agreements, defending and resolving claim objections, advising on the sale of claims, and developing post-petition strategies tailored to the needs of sophisticated stakeholders. He also regularly represents lessors in negotiations involving lease assumption, rejection, and adequate assurance.
Licensed to practice in New York and New Jersey, Mr. Banker frequently serves as a local resource for professionals handling matters in those jurisdictions, providing on-the-ground insight and coordination in complex Chapter 11 proceedings.
He has represented unsecured creditors’ committees in numerous high-profile cases, including Prime Core, Novan, Tuesday Morning, Orchids Paper, CST Industries, Willowood USA Holdings, Centerstone Linen, Prestige Industries, Noranda Aluminum, Borders Group, SP Newsprint, Gourmet Express, Chef Solutions, Advanced Marketing Services, Koen Book Distributors, Solaris Industries, and Xtera Communications. He also represented the Official Committee of Equity Security Holders in the Pyxus International bankruptcy.
Mr. Banker has extensive experience representing parties in preference and fraudulent conveyance actions in jurisdictions throughout the United States. He has written and presented on these topics and is a certified mediator on the registers of mediators for the United States Bankruptcy Courts for the Southern District of New York and the District of Delaware. In that capacity, he has served as a mediator in avoidance actions arising from major bankruptcy cases, including Sears/Kmart, Fyre Festival, CalPlant, Packable Holdings, Art Van Furniture, Patriot National, Loehmann’s, GT Advanced Technologies, Vivaro, and Wirefly Mobile.
